2. Personal Data Collected

FERCA collects the following personal data:

  • Contact form: name, email address, phone number and message.
  • Navigation data: IP address, browser type, operating system and pages visited, collected automatically by servers for security and technical operation.
  • Cookies: as described in section 9.

No special categories of data (health, ethnic origin, religious beliefs, etc.) are collected through this website.

3. Purposes and Legal Basis

  • Responding to contact and information requests — Legal basis: data subject's consent (Art. 6(1)(a) GDPR).
  • Management of commercial relationships and service delivery — Legal basis: performance of a contract or pre-contractual steps (Art. 6(1)(b) GDPR).
  • Compliance with legal obligations — Legal basis: legal obligation (Art. 6(1)(c) GDPR).
  • Website security and technical operation — Legal basis: FERCA's legitimate interests (Art. 6(1)(f) GDPR).

4. Data Retention

  • Contact form data: retained for the period necessary to respond and, if a commercial relationship is established, for the legally required period or up to 5 years after last contact.
  • Invoicing and contractual data: retained for the minimum period required by law (typically 10 years).
  • Navigation data / logs: retained for a maximum of 12 months.

After the retention period, data is securely deleted or anonymised.

5. Data Sharing and Recipients

Your personal data is not sold, rented or shared with third parties for commercial purposes. Data may be shared with:

  • IT service providers acting as processors (hosting, email), bound by data processing agreements ensuring adequate protection.
  • Public authorities, when required by law or court order.

6. International Transfers

Where data is transferred outside the European Economic Area (EEA), FERCA ensures that appropriate safeguards are in place as required by the GDPR, including European Commission adequacy decisions or standard contractual clauses.

7. Your Rights

Under the GDPR, you have the following rights:

  • Right of access (Art. 15): obtain confirmation and a copy of your personal data being processed.
  • Right to rectification (Art. 16): correct inaccurate or incomplete data.
  • Right to erasure (Art. 17): request deletion of your data ("right to be forgotten").
  • Right to restriction of processing (Art. 18): restrict processing in certain circumstances.
  • Right to data portability (Art. 20): receive your data in a structured, machine-readable format.
  • Right to object (Art. 21): object to processing based on legitimate interests.
  • Right not to be subject to automated decisions (Art. 22): not to be subject to decisions based solely on automated processing.
  • Right to withdraw consent: at any time, without affecting the lawfulness of prior processing.

8. Data Security

FERCA implements appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, accidental or unlawful loss or destruction. In the event of a personal data breach posing a high risk to data subjects, they will be notified in accordance with Art. 34 GDPR.
